PREAMBLE
1. These general conditions of sale are agreed between Anadiagro, Lda, with registered office at Rua Lagoa do Paúl no. 6, 3780-054 Ancas, contact +351 231 504 678, hereinafter referred to as “Casa do Canto” and the people who wish to make purchases through the website www.casadocanto.com, hereinafter referred to as “User”.
2. The parties agree that purchases made through the website www.casadocanto.com will be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
ARTICLE 1 – OBJECT
1. The purpose of these general conditions of sale is to provide and define all the information necessary for the User regarding ordering, selling, payment and delivery modalities for purchases made on the website www.casadocanto.com
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties
ARTICLE 2 – ORDERING
1. The User places their order by completing the purchase process presented on the website www.casadocanto.com, adding the product(s) or service(s) they wish to order to the shopping cart;
2. To send your order, the User must:
a) Register on the website www.casadocanto.com, providing the information requested there.
b) Log in (providing a combination of email and password chosen by the User at the time of registration).
c) Complete the information and choose the options that are available to you throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and the name that, for tax purposes, you want shown on the invoice).
3. The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.
4. Casa do Canto will honor orders received online only up to the limit of available stocks. If the product is unavailable, Casa do Canto undertakes to inform the User as soon as possible.
5. The data contained in the invoice is the sole responsibility of the User. The invoice once issued cannot be reissued with changes.
6. Order requests are valid for 5 working days (five) days, unless the order is registered under a promotional campaign that defines a different deadline, and it is not possible to guarantee prices, discounts, promotions and offers beyond of this period. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.
ARTICLE 3 – PAYMENT
1. On the website www.casadocanto.com, Anadiagro, Lda offers the User the following payment methods:
a) Bank transfer;
b) MBway
2. If some ordered products are out of stock, their value will be refunded to the User, after the order has been dispatched.
3. Payments are received in euros, regardless of the currency in which the transaction is carried out; The costs associated with conversion fees for payments made in other currencies will be borne by the customer.
ARTICLE 4 – DELIVERY
1. In general, after dispatch, an order at Casa do Canto takes a while to be delivered:
– 72 hours in mainland Portugal;
– Between 5 and 9 working days on the Islands of Madeira and Azores;
– Around 4 working days in Iberian peninsula;
– Around 6 working days in the rest of Europe;
– Approximately 7 business days in the rest of the world.
2. The respective shipping costs are added to the prices shown on the products for each order, which are calculated based on the transportation cost. The shipping cost depends on the weight of the order and its delivery destination. This shipping value can be simulated within the shopping cart with the desired products added and filling in all the requested fields in the simulator. The total shipping costs will also be automatically calculated when placing your order in the Online Store. Please note that the factors in this calculation may be variable and may undergo changes without prior notice.
3. After orders have been dispatched, information for monitoring shipping will be available in the account of customers who have placed the order with registration and a notification is also sent via email with information on the link for monitoring shipping to all customers registered and unregistered. If for any reason the customer does not receive shipping confirmation, they are requested to contact Casa do Canto, using one of the contact details available on the website www.casadocanto.com so that all available information regarding the shipping of the item can be sent again.
4. After notification of shipment, customers must monitor the status of the shipment through the link provided by Casa do Canto, so that they are aware of the progress until the moment the order is delivered, as Casa do Canto, does not notify each time the shipment status changes.
5. All products sent by Casa do Canto must be checked upon delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Casa do Canto through one of the contacts available on the website www.casadocanto.com or by email casadocanto@anadiagro.pt
6. If after delivery, the customer finds that any of the items are not in conformity, they are requested to immediately contact Casa do Canto, via email at casadocanto@anadiagro.pt indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all items, so that the process of investigating the occurrence can be opened internally and the situation can be resolved as quickly as possible.
7. Casa do Canto is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the customers' responsibility to seize their orders, as well as pay customs fees, if any. If products are returned, Casa do Canto will only refund the amount corresponding to these products. If you have any questions, you can contact Casa do Canto before ordering.
8. Casa do Canto has contracted services with specialized carriers for deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet shipping and delivery deadlines, however, it is important to note that possible delays in deliveries may be beyond the control of Casa do Canto, and it is not possible, in these cases, to guarantee exact delivery deadlines.
9. Most deliveries are made during office hours on business days to the shipping address indicated by the customer when submitting the order
10. In case of unsuccessful delivery attempts by the transport company due to absence, a delivery notice is always left in the customer's mailbox with the carrier's details. Depending on the service and the carrier, orders must be collected at the location indicated by the carrier in the transit notice, or the instructions requested in the same notice must be followed.
11. If for any reason the customer is unable to receive the order or pick it up at the location indicated by the carrier, the customer is asked to contact Casa do Canto so that together the most appropriate solution can be found.
ARTICLE 5 – PRICES
1. Prices must be expressed in Euros, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.
2. If there is an increase in the Price of any product, the User will be informed immediately, and may choose to receive their order (paying the difference) or cancel it.
3. Casa do Canto reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.
4. The images that illustrate each product at Casa do Canto may differ from the product subsequently delivered, and these same products are also subject to out of stock. In the event of a temporary or permanent stock out, the customer will be informed and, whenever possible, an alternative product with similar characteristics will be indicated.
5. If it is not possible to satisfy the customer's needs, the payment already made will be refunded in full and at no additional cost to the customer;
6. Shipping and transport service costs are the responsibility of the buyer and are added to the total value of the selected products; the user will be informed of these charges before confirming their order and completing the purchase process;
7. If, when formalizing the order, a computer, manual, technical or any other error occurs, which causes a substantial change – understood in the sense that the price communicated proves to be disproportionate, as it is exorbitant or manifestly insignificant – and involuntary on the part of Casa do Canto in the sale price to the public, the purchase order will be considered invalid and canceled.
ARTICLE 6 – CANCELLATION AND RETURN
1. Casa do Canto recognizes that all its customers have the right to terminate the contracts they have signed with it, allowing them to return, within 14 (fourteen) days, products purchased under the terms of Decree-Law no. 143/2001 and Decree-Law 82/2008 of 20/05.
2. To request an exchange or return, the customer is asked to contact Casa do Canto via email at casadocanto@anadiagro.pt indicating the order number or the number of the document that accompanied the order, taking into account the conditions broken down below into the following topics:
a) To return the order, the product must be in perfect condition, and where appropriate with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b) The return of defective products and incorrect shipments will be permitted, with Casa do Canto being responsible for shipping and collection costs whenever the customer communicates this circumstance within 14 (fourteen) days from the date of receipt of the product.
c) Once the merchandise has been received at our facilities and after validating its condition accordingly, the value will be returned in accordance with the payment method made by the customer, or another solution previously agreed with the customer.
3. Casa do Canto assumes responsibility arising from defects in the origin or raw material of the purchased product and if this is confirmed by the Casa do Canto specialized team, the product will be exchanged or returned at no cost to the customer.
4. Casa do Canto will not accept the return of the product after it has been used, or if it has been opened, altered or modified.
5. Casa do Canto is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or causes of force majeure.
6. For the purposes of exchange or return, an email must be sent in advance to casadocanto@anadiagro.pt informing the fact and the reason behind the exchange or return, indicating the order number;
7. If the customer does not follow the instructions provided here, Casa do Canto may refuse to accept the exchange of the product or its return and, in the latter case, issue the corresponding refund.
